Terms of Service

These terms govern your use of GroupTag (“we,” “us,” or “our”) — an AI-powered photo sharing service that works over SMS. By using the Service, you agree to these terms. If you have questions, email us at kohra.team@gmail.com.

Important Legal Notice

By using the Service you agree to these terms, confirm you are at least 13 years old, and acknowledge that Section 14 contains a mandatory arbitration clause and class action waiver. Unless you opt out within 30 days, disputes must be resolved through individual arbitration — not court or jury trial.

1. What GroupTag Does

GroupTag lets you create shared photo albums over SMS, invite friends to upload, and receive AI-matched photos of yourself — no app download needed. We use face recognition, image classification, and generative AI to process content and respond to requests. AI features are not guaranteed to be accurate; use your own judgment.

2. Registration & SMS Consent

You register by texting GroupTag from your phone. By doing so, you consent to receive SMS and MMS messages from GroupTag using automated messaging technology (ATDS). This consent is not required to purchase anything. Standard message and data rates apply.

You are responsible for keeping your account information accurate and for all activity under your account. Reply STOP to unsubscribe or email us to delete your account. Reply HELP for support. Wireless carriers are not liable for undelivered messages.

3. Your Content

You own the photos and content you upload. By uploading, you grant GroupTag a worldwide, royalty-free license to store, process, and display your content to provide the Service. Your content may also be used to train and improve our AI models — you can opt out of this at any time by emailing us.

Your private content is never shared with other users outside your album. You are responsible for having the rights to upload and share any content, including photos of other people.

4. Face Recognition & Biometric Data

GroupTag uses face recognition to match people in photos. By uploading photos or joining an album, you consent to the collection and processing of facial geometry data for this purpose. This data is not sold or shared with third parties. You can request deletion at any time by contacting us.

If you upload photos of other people, you represent that you have their consent or are otherwise authorized to share those photos.

5. What You Can't Do

You agree not to:

Sell, resell, or commercially exploit the Service;
Reverse engineer, scrape, or otherwise attempt to extract our code or data;
Impersonate GroupTag or another user;
Interfere with the Service or introduce malicious code;
Upload illegal, harmful, abusive, or sexually explicit content;
Upload photos of others without their consent;
Upload any content involving exploitation or abuse of minors;
Promote hate, discrimination, or violence against any group.

GroupTag may remove content, suspend, or terminate accounts that violate these rules at any time.

6. Intellectual Property

GroupTag owns all rights to the Service, including its AI models, software, design, and trademarks. Nothing in these terms grants you any ownership rights in the Service. GroupTag's name and logo may not be used without prior written permission.

7. Payment

GroupTag is currently free. If we introduce fees, we'll notify you in advance.

8. Indemnification

You agree to defend and hold GroupTag harmless from any claims, losses, or expenses (including attorneys' fees) arising from your content, your use of the Service, or your violation of these terms or any applicable law.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. GroupTag does not guarantee the Service will be uninterrupted, error-free, or that AI results will be accurate. GroupTag does not review or endorse user-uploaded content and is not liable for it.

10. Limitation of Liability

To the fullest extent permitted by law, GroupTag is not liable for any indirect, incidental, or consequential damages. GroupTag's total liability for any claim is capped at $100 or the amount you paid us in the prior three months, whichever is greater.

11. Termination

You can delete your account anytime by texting DELETE MY ACCOUNT or emailing us. GroupTag may suspend or terminate your access at any time if you violate these terms. Upon termination, your license to use the Service ends immediately. Sections covering liability, indemnification, and dispute resolution survive termination.

12. DMCA / Copyright

If you believe content on GroupTag infringes your copyright, send a DMCA notice to kohra.team@gmail.com including: your signature, identification of the infringed work, identification of the infringing material, your contact information, and a good-faith statement that the use is not authorized. False notices may result in liability under 17 U.S.C. § 512(f).

13. Governing Law

These terms are governed by the laws of the State of California. Any court proceedings (where permitted) will take place in California.

14. Dispute Resolution & Arbitration

Mandatory Arbitration

Most disputes must be resolved through binding individual arbitration — not court, not class action, not jury trial. Please read this section carefully.

Arbitration: Any dispute arising from your use of GroupTag will be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except for (i) small claims court matters, or (ii) intellectual property disputes where injunctive relief is sought. The Federal Arbitration Act governs.

No class actions: You and GroupTag may only bring claims against each other individually. No class arbitrations, class actions, or representative proceedings.

Informal resolution first: Before starting arbitration, both parties agree to meet and confer in good faith for 30 days to try to resolve the dispute informally.

Opt-out: You may opt out of arbitration within 30 days of first using the Service by emailing kohra.team@gmail.com with the subject “Arbitration Opt-Out” and your name. Opting out does not affect any other part of these terms.

15. General

We may update these terms at any time. We'll notify you of material changes via SMS or email; continued use means you accept the update. You may not assign these terms without our consent. GroupTag is not liable for failures due to events outside our control (force majeure). If any provision is found unenforceable, the rest remain in effect. These terms, together with our Privacy Policy, are the entire agreement between you and GroupTag.
